{"id":33888,"date":"2021-11-19T09:00:34","date_gmt":"2021-11-19T08:00:34","guid":{"rendered":"https:\/\/spanish.rberzal.com\/new-spains-startup-law-tax-cuts-and-visa-for-digital-nomads\/"},"modified":"2025-11-06T17:49:46","modified_gmt":"2025-11-06T16:49:46","slug":"new-spains-startup-law-tax-cuts-and-visa-for-digital-nomads","status":"publish","type":"post","link":"https:\/\/spanish.rberzal.com\/es\/new-spains-startup-law-tax-cuts-and-visa-for-digital-nomads\/","title":{"rendered":"NEW SPAIN&#8217;S STARTUP LAW: TAX CUTS AND VISA FOR DIGITAL NOMADS"},"content":{"rendered":"<p>BLOG POST WRITTEN BY <a href=\"https:\/\/www.scornik.com\/\">SCORNIK GERSTEIN LLP<\/a><\/p>\n<p style=\"text-align: left;\">On 6th July 2021, the Spanish Government published a new draft bill known as the<a href=\"https:\/\/www.scornik.com\/blog\/173-corporate-commercial\/567-the-new-spanish-start-up-law-tax-cuts-and-benefits-for-investors\"><strong> Start-up Law<\/strong> <\/a>to encourage entrepreneurs and digital nomads to <strong>relocate to Spain by offering tax cuts and a new visa category for non-EU citizens.<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>SPANISH START-UP LAW (also know as) DIGITAL NOMAD VISA VS NON LUCRATIVE VISA<\/p>\n<p>Currently many Non-Eu residents and therefore Britons, who wish to permanently reside in Spain, apply to the<strong> Spanish Non Lucrative visa<\/strong>, suitable for those who have passive income, savings or pensions available since this type of visa does not allow the applicant to perform an economic activity.<\/p>\n<p>The new Digital Nomad Visa, will however <strong>allow them to work<\/strong> under the following conditions:<\/p>\n<ul>\n<li>\u00a0Be Non-European Economic Area <strong>(EEA)<\/strong> citizens<\/li>\n<li>Be able to show that his professional services or work is suitable to be carried out remotely<\/li>\n<li>If employed, only by a non-Spanish resident company for at least the last 3 months and which has been trading for more than 1 year<\/li>\n<li>If self-employed, be able to show that has been providing their services for at least the last 3 months, to non-Spanish clients and up to a maximum of 20% of his activity to Spanish resident clients.<\/li>\n<li>Have a University or professional or business training degree or more than 3 years of professional experience<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>The Spanish Start-up Law visa <strong>will last for a year or 2 years<\/strong> if the applicant is already residing in Spain and can be renewed if the above conditions are maintained.<\/p>\n<p>&nbsp;<\/p>\n<p>WHEN WILL BE POSSIBLE TO APPLY FOR THE NEW SPANISH DIGITAL NOMAD VISA?<\/p>\n<p>The Start-Up law and accordingly, its new \u201cDigital Nomad\u201d visa category is currently in its draft format, submitted by the government for debate to the Senate on 6th July 2021.
